It was tough for Scherzer to lose the perfect game the way he did the pitch was definitely ball 3 although by rule and this is very rarely enforced it could have been called strike 3 if the umpire determined that Tabata leaned into the pitch deliberately personally I think he did lean in although the slider got away from Scherzer which is why the call of a hit batsman stood

Losing a perfect game in the 9th with 2 outs is the most unfortunate thing that can happen to a pitcher, no hitter or not.
