Couldn't they ban it on the grounds that it sensationalizes and encourages or condones conduct that would most certainly be illegal? As Danish Kaleem said, the people who wrote the constitution had no way to conceptualize the idea of television or how it can affect people and show them things taking place outside the jurisdiction of the United States. Horror movies, wherein the gruesome deaths of the characters are fabricated, are censored at the discretion of individuals other than the Supreme Court–but I think there are problems with showing real human lives end on a screen.
